These General Terms and Conditions of Sale (GTC) govern all sales of new and used vehicles made by Autoservice-import, an agent specializing in the import and export of vehicles from Germany to Europe and overseas territories.

1. Scope of Application
These GTC apply to all vehicle orders placed with Autoservice-import by individual customers. Placing an order implies full and unreserved acceptance of these GTC.

Purchases made by professionals or legal entities are excluded from the right of withdrawal.

2. Customer's Legal Capacity
The customer declares that they are of legal age and legally capable of entering into a contract in accordance with applicable law.

3. Pre-contractual Information
Autoservice-import provides the customer with the following information before any order:

The essential characteristics of the vehicle,

The total price including VAT,

Any additional charges,

Delivery times and methods,

Applicable warranties.

The photos, descriptions, and documents provided are contractually binding and accurately reflect the condition of the vehicle.

4. Ordering Process
The customer confirms their intention to purchase.

They submit the required documents:

Valid identification (identity card or passport),

Proof of address,

Complete contact information (postal address, telephone number, email address).

An order form and a sales contract are drawn up in the customer's name.

After signature and receipt of the deposit, the vehicle is reserved and taken out of sale for a period of 24 hours.

5. Price and Payment Terms

5.1 Price The prices displayed are fixed, firm, and non-negotiable, expressed in euros (€), inclusive of all taxes.

5.2 Deposit and Balance Vehicle < €10,000: Deposit: 80% of the vehicle price Logistics Fees: €1,250 (Europe) €2,000 (Overseas) Vehicle ≥ €10,000: Deposit: 30% of the vehicle price Logistics Fees: €1,250 (Europe) €2,000 (Overseas) Balance: payable upon delivery of the vehicle.

5.3 Discount A 10% discount is granted for all full payments made at the time of order (vehicles ≥ €10,000).

5.4 Payment Method Payments are made exclusively by bank transfer to the account of the authorized agent. Bank details are provided on the order form. An order tracking code is provided after payment confirmation.

5.5 Financing Financing may be offered subject to approval, with a promotional rate of up to 0% depending on conditions.

6. Delivery

6.1 Delivery Times Europe: 5 to 7 business days Overseas Territories: 28 to 30 business days These delivery times are indicative and may vary in the event of force majeure.

6.2 Delivery Methods Home delivery or delivery to a nearby collection point in case of difficult access, Secure transport by truck (Europe) or sea container (Overseas Territories), Delivery time confirmation by SMS, Modification possible up to 12 hours before delivery. If the customer does not respond for more than 3 days, a storage fee of €15/day may be charged.

7. Vehicle Inspection and Acceptance Upon delivery, a delivery report will be completed jointly with the customer. Any reservations must be noted at the time of vehicle handover. If no reservations are noted, the vehicle will be considered compliant and accepted as is.

8. Documents Provided to the Customer Upon Delivery Temporary registration certificate (WW) valid for 4 months, WW garage plates, 30-day temporary insurance, Transfer certificate, Lien certificate, Vehicle inspection report, Maintenance logbook and invoices, Mileage certificate. After Delivery Final registration certificate will be issued within 14 days.

9. Warranty The vehicles are covered by: The legal warranty of conformity, The warranty against hidden defects, A 48-month contractual warranty, covering in particular: Engine, Transmission, Brakes, Steering, Suspension, Electrical system, Air conditioning and equipment. An authorized partner garage may be designated for maintenance and repairs.

10. Right of withdrawal In accordance with the Consumer Code: The customer has 14 days after delivery to withdraw from the contract without giving any reason. Autoservice-import will handle the return of the vehicle. A full refund will be issued within 14 days of receipt of the withdrawal form and return of the vehicle. This right does not apply to professionals.

11. Delay or Non-Delivery In the event of a significant delay, the customer may: Send formal notice to Autoservice-import, Cancel the order in accordance with Article L216-2 of the French Consumer Code, Obtain a full refund of all sums paid in the event of non-delivery.

12. Liability Autoservice-import shall not be held liable for delays or non-performance due to force majeure.

13. Applicable Law and Disputes These Terms and Conditions are governed by French law. In the event of a dispute, an amicable solution will be sought first. Failing that, the competent courts will be seized in accordance with the rules of ordinary law.
